Illegal narcotics are a scourge that our nation and the entire world continues to battle for the souls of all people. In the DEA’s 2015 National Drug Threat Assessment[1], the number of drug induced deaths has risen steadily since 2004, surpassing firearm-related deaths in 2005 and vehicular deaths in 2009. On Long Island and in Westchester, New York, the scourge of heroin has become a daily thread in news reports.

According to The National Center on Addiction and Substance Abuse[2], commonly used illegal drugs include marijuana, heroin, cocaine, amphetamines, methamphetamines and club drugs. Drug-related crime breaks down into three separate categories:

  • Trafficking
  • Distribution
  • Illegal use.

For the first two, these are activities that are engaged in for profit.  Committing these crimes is not looked upon sympathetically by society. Sometimes a client is facing narcotics charges merely for being inside the same room or vehicle where the narcotics are found. This is called a presumption case.
